Terms and conditions

§ 1 Definitions

For the purposes of this regulation, the following meanings of the terms are assumed:

Buyer - a natural person, legal person, or incapacitated legal person,

Consumer - a natural person concluding an agreement with the Seller not directly related to their business or professional activity,

Payment Operator - BlueMedia,

Regulation - this regulation, available at https://ehsconsulting.bhpsoft.pl/regulamin,

Store - an online store available at https://ehsconsulting.bhpsoft.pl/,

Seller - EHS Consulting Ltd. with its registered office in Warsaw at Złota 75A/7, postal code 00-819, registered in the Entrepreneurs' Register kept by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register under the KRS number: 0001003590, VAT ID: 5273029212, REGON: 523720761.

 

§ 2 Preliminary Provisions

1.Through the Store, the Seller conducts the sale of digital products, simultaneously providing services to the Buyer electronically in accordance with § 3 of the Regulation.

2. The Regulation defines the rules and conditions for using the Store, as well as the rights and obligations of the Seller and the Buyer.

3.Specific technical conditions for the Buyer's computer or other devices are not required to make a purchase through the Store. The following are sufficient:

4. The technical requirements that the Buyer's computer or other devices must meet to use the purchased digital product are indicated in each product's description.

5.The Buyer cannot make a purchase anonymously or under a pseudonym.

6.It is prohibited for the Buyer to provide unlawful content, especially by sending such content through forms available in the Store.

7.All prices listed in the Store are net prices, except for the prices of online periodic training, which are gross prices exempt from VAT.

 

§ 3 Services Provided Electronically

1.Through the Store, the Seller provides the Buyer with an electronic service enabling the conclusion of an agreement with the Seller for the delivery of digital content in the form of digital products available in the Store. The conclusion of the agreement is not possible without having an account in the Store. The procedure for concluding the agreement is described in detail in § 4 of the Regulation.

2.Creating an account is possible while placing an order according to the procedure described in § 4 of the Regulation.

3.The services provided are free of charge to the Buyer. However, agreements for the delivery of digital content concluded through the Store are subject to payment.

4.To ensure the Buyer's security and data transfer in connection with using the Store, the Seller takes technical and organizational measures appropriate to the level of security threats of the services provided, especially measures to prevent unauthorized access or modification of personal data.

5.The Seller takes action to ensure the full and proper functioning of the Store. The Buyer should inform the Seller of any irregularities or interruptions in the functioning of the Store.

6.All complaints related to the functioning of the Store can be reported by the Buyer via email to biuro@ehsconsulting.pl. In the complaint, the Buyer should provide their name, address for correspondence, as well as the type and date of any irregularities related to the functioning of the Store. The Seller will handle all complaints within 14 days of receiving the complaint and will inform the Customer of its resolution at the email address provided in the complaint.

 

§ 4 Conclusion of Agreement

1.To purchase an electronic product, the Buyer must take the following steps:

2.Upon clicking the "Place order" button, the Buyer will be redirected to the Payment Operator's website to make the payment for the selected digital products.

3.After successful payment, the Buyer will be redirected to the confirmation page. At that moment, the agreement for the delivery of digital content in the form of selected digital products is considered concluded between the Buyer and the Seller. The Buyer will also receive a purchase confirmation at the email address provided in the order form. Within 24 hours of the payment being received, the Seller will provide the Buyer with the digital product via email.

 

§ 5 Delivery of Digital Product

The delivery of the purchased digital product occurs as specified in the description of the particular electronic product.

 

§ 6 Consumer's Right of Withdrawal from the Agreement

1.The consumer who has concluded a distance contract with the Seller has the right to withdraw from the contract without giving any reason within 14 days from the date of concluding the contract.

2.The right to withdraw from a distance contract does not apply to the consumer in relation to contracts for the supply of digital content not stored on a tangible medium if the performance has begun with the consumer's express consent before the withdrawal period and after being informed by the entrepreneur about the loss of the right to withdraw from the contract.

3.To exercise the right of withdrawal, the Consumer must inform the Seller of their decision to withdraw from the contract by means of an unambiguous statement - for example, a letter sent by post or email.

4.To maintain the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information regarding the exercise of their right to withdraw from the contract before the expiration of the withdrawal period. In the event of withdrawal from the contract, the Seller refunds to the Consumer all payments received from the Consumer promptly, no later than 14 days from the day on which the Seller was informed about the exercise of the right of withdrawal from the contract.

 

§ 7 Liability for Defects

1.The Seller is obliged to provide the Buyer with a digital product free from defects.

2.The Seller is liable to the Buyer if the digital product has a physical or legal defect (warranty for defects).

3.If the Buyer discovers a defect in the digital product, they should inform the Seller, specifying their claim related to the identified defect or submitting a statement of relevant content.

4.The Buyer can contact the Seller by both traditional mail and email.

5.The Seller will address any complaints submitted by the Buyer within 14 days from the date of receiving the complaint, using the means of communication through which the complaint was filed.

 

§ 8 Personal Data and Cookies

The rules for processing personal data and using cookies are described in the privacy and cookies policy available at https://ehsconsulting.bhpsoft.pl/polityka-prywatnosci.

 

§ 9 Out-of-Court Complaint Resolution and Claims Enforcement Methods

1.The Seller agrees to submit any disputes arising in connection with concluded agreements for the delivery of digital content to mediation. Details will be specified by the conflicting parties.

§ 10 Final Provisions

1.The Seller reserves the right to introduce and withdraw offers, promotions, and change product prices in the Store without affecting the rights acquired by the Buyer, especially the terms of contracts concluded before the change.

2.The Seller reserves the right to make changes to the Regulation. The Regulation in force at the time of concluding the contract applies to agreements concluded before the Regulation change.

3.Buyers who have an account in the Store will be notified via email to the email address associated with their account of any changes to the Regulation. If the Buyer does not accept the content of the new Regulation, they have the right to terminate the account agreement at any time by deleting the account or submitting a relevant statement to the Seller, in any form, terminating the account agreement.

4.This Regulation is effective from May 24, 2023.
